Duties / Obligations of Agent
- Agent is bound to collect the payments from individuals / entity / organization or any third party, on behalf of Principal as per the directions given by Principal.
- Agent is bound to transfer the funds collected on behalf of the Principal as per the directions given by the Principal.
- Agent will not use funds collected on behalf of the Principal for its own use.
- In cases of difficulty, to use all reasonable diligence in communicating with its Principal, and in seeking to obtain its instructions .
- If an agent deals on his own account in the business of the agency, the Principal may repudiate the transaction.
- Agent will provide online platform CITYNEEDS.INFO to the individuals / entity / organizations / third party from whom the funds are collected, where all the necessary information about Principal and its projects will be reflected and viewed to third parties.
- Agent will provide the online payment gateway through its website named CITYNEEDS.INFO for transfer of funds from individuals / entity / organizations or any third party to the Agent’s Bank Account for the cause.
- Agent can deduct / retain payment gateway charges / bank charges / Advertisement & Promotion expenses or similar nature expenses spent during collection of funds offline or online as the case may be, at the time of transferring funds to the Principal collected on behalf of the Principal.
- Agent will provide the receipts or similar documents to the donors as per the directors given by the Principal.
- Agent will collect payments only from the individuals / entity / organizations or any third party, only and transfer it to the Principal as per the directions given by the Principal.
- That in the event of any dispute arising between Agent / Principal and third party from whom funds are collected, Agent is responsible till funds are not transferred to the Principal. Once funds are transferred to the Principal, Principal is responsible for such disputes.
- Principal is responsible for any lack of information regarding utilization of funds / loss of any goods / misstatements given by the Principal. Agent is not responsible for such type of lacks.
- All the campaigns at the CITYNEEDS.INFO will be updated by the Principal only and Agent is not responsible for any campaign in any manner.
- Agent is only providing Platform named CITYNEEDS.INFO where an individual / entity / organization or any other third party can donate according to their wish for a cause stated.
Duties / Obligations of Donor
- Donation once made by donor is non-refundable under all circumstances.
- Donor can make payment through Netbanking / Debit Card / Credit Card / UPI and Payment Wallets against causes posted on website.
- Donor can create its account at online website named CITYNEEDS.INFO which is free and the login credentials will not be asked by the Agent / Principal. Donor will be solely responsible for the acts done through Donor’s account.
- Donor will transfer the amount they wish to donate to the bank account of the Agent through website named CITYNEEDS.INFO either though its account or entered as GUEST.
- Donor will check the credibility of the NGO / Trust by itself. Agent is not responsible for providing such information to the Donor regarding any NGO / Trust or its projects in any manner.
- Donor may ask about the areas where funds is utilized / goods or any item from Principal only. Agent is not bound to provide such information to the Donor in any manner.
- Donor will get the receipt of the amount contributed / goods donated through email only.
- In case of any dispute regarding the utilization of funds / goods donated / lack of information / misstatement or such type of issue, Donor may ask Principal. Agent will not be responsible for such dispute regarding the utilization of funds / goods donated / lack of information / misstatement or such type of issue once funds / goods are transferred to the Principal by Agent.
- Donor if want to get benefit of Income tax, must check the 80G status of NGO before making any donations. Certification of the same will be provided by NGO to donor directly.
